Assault

Drug Charges: Possession, Delivery, and Manufacturing

From possession of small amounts of marijuana to major drug manufacturing or delivery charges, Drew K. Baumchen has the experience and knowledge to help you fight your drug case.  Drug cases almost always involve some sort of search by the police.  In fact, many major drug cases involve search warrants obtained by the police or the use of drug-sniffing dogs, or sometimes even both.  While working in the District Attorney's Office, Drew handled numerous drug cases and investigations, and is experienced and knowledgeable about Oregon's drug laws, as well as the legal protections you have against unreasonable searches and seizures by the police.  Not only is Drew an expert in drug-dog cases but he also has ample experience with search warrants and knows exactly what sort of challenges can be made to get a search warrant thrown out of court.  Drew knows that just because the police have a drug-dog or a search warrant doesn't mean that they can violate your constitutional rights.

In addition to challenging searches and search warrants in drug cases, Drew K. Baumchen is also very familiar with Oregon's complex sentencing laws for drug offenses.  Under Oregon's Felony Sentencing Guidelines, drug offenses can become much more serious depending on the amount of illegal substances involved, whether there was a financial motivation for the offense, and if the offense is designated as a "Commercial Drug Offense," which usually involves a number of factors.  Drew has extensive experience with these special sentencing laws, will take the time to be sure that you understand the charges against you and the potential penalties they carry, and will work with you to defend your drug possession, delivery, or manufacture case.

Expungements

In today's information age, a criminal record can follow you wherever you go.  An arrest or conviction for even a misdemeanor can keep you from getting a job, an occupational or professional license, or even getting into some colleges or trade schools.  A felony conviction may have even more severe consequences and could prevent you from lawfully owning, purchasing, or even possessing a firearm.  Fortunately, Oregon law allows a person to clear their criminal record if they meet certain qualifications.  Drew K. Marijuana and Medical Marijuana

While many today feel that marijuana is relatively harmless, the penalties for possessing, growing, or distributing marijuana are still far from it.  A conviction for possession of just a very small amount of marijuana, or even a pipe or marijuana "bong," could result in a driver's license suspension of six months or more and disqualification from federal Financial Aid programs for college students.  And while Oregon state law is generally softer on marijuana offenses compared to federal law, a conviction for manufacturing (growing), delivering (distributing), or even simply possessing a large amount of marijuana could result in probation, jail, or even prison.  Fortunately, Drew K. Baumchen has extensive experience with Oregon's complicated marijuana laws and can help defend you on these often very serious charges.

Oregon was one of the first states in the U.S. to pass a law legalizing the use of marijuana for medicinal purposes.  Under the Oregon Medical Marijuana Program, people who possess a valid license from the Oregon Department of Human Services can legally grow and possess moderate amounts of marijuana.  Even people who don't possess a valid medical marijuana card can sometimes assert the medical necessity of marijuana as a defense in a criminal case.  However, the rules regulating the growth, possession, and use of medical marijuana are very strict and it's easy for even the most well-meaning medical marijuana patient to run afoul of the law and end up cited, arrested, or worse.  Drew K. Baumchen is knowledgeable about Oregon's medical marijuana laws and has the skill and experience to defend cases involving medical marijuana.  Not only can Drew help defend you if you are charged with a case involving medical marijuana, but he is also available to counsel or advise patients, growers, and caretakers on the laws regulating medical marijuana and what a patient or other card-holder must do to comply with these rules.
 

Measure 11

Ballot Measure 11 was enacted in 1994 by Oregon voters to prescribe mandatory minimum sentences for serious violent and sexual offenses.  Measure 11 crimes are generally the most serious criminal offenses under Oregon law and difficult to defend because they take discretion away from the judge and even the prosecutor.  Drew K. Baumchen has experience handling Measure 11 cases, and he knows the strict laws regarding these types of offenses and how to work around them, when possible.

Often, early intervention is key to minimizing the charges being filed or preventing them from being filed at all.  As a former prosecutor himself, Drew K.
